If you worked for Groendyke Transport Inc. as a logistics coordinator at any time from June 29, 2019, to present, you may be entitled to join a lawsuit for unpaid wages and money damages.
Please read this notice carefully as it may affect your Legal rights to receive compensation related to, and resulting from, your employment with Groendyke Transport Inc.
You may be eligible to join and make a claim in this lawsuit if you worked as a logistics coordinator for Groendyke at any time from June 29, 2019, and today; and were paid a salary for all hours worked, including hours worked over forty (40) hours in a workweek.

Why Am I Receiving This Notice?
This Notice is provided in connection with an overtime collective action lawsuit pending in the United States District Court for the Western District of Oklahoma (“the court”). Plaintiff alleges that Groendyke (“Defendant”) violated the Fair Labor Standards Act (“FLSA”) by improperly classifying its logistics coordinators as exempt employees, as a result, failed to pay Plaintiff and the other logistics coordinators overtime compensation. Groendyke disputes liability, including the allegations that it improperly classified Plaintiff and other logistics coordinators as exempt employees and failed to pay overtime wages, in violation of the FLSA, for the hour worked over forty (40) in a workweek.
You may be eligible to join and make a claim in this lawsuit if:

What Happens if I Join This Lawsuit?
By timely submitting the Consent Form you will be part of this case and represented by the same attorneys. If you join this lawsuit, you will be bound by the judgment of the Court, whether it is favorable or unfavorable. If plaintiffs win or a settlement is reached, you may be entitled to a sum as part of the judgment or settlement. If this case not successful, you will receive nothing, but you will not be responsible for any case costs, expenses, or attorneys’ fees. If you join the lawsuit, you may or may not have to provide records, answer written questions, or testify under oath.

What Happens if I Do Not Join This Lawsuit?
By doing nothing, you are choosing not to participate in this lawsuit, and you will not be represented by Plaintiff’s counsel. The decision to join is entirely yours.
If any money is awarded, you will not be entitled to money received as part of a judgment or settlement, and you will not be bound by the judgment in this lawsuit or by the terms of a settlement (if one is reached) whether favorable or unfavorable. If you do not join this lawsuit, your rights to sue Groendyke separately at a future time, for the same or related claims, to the extent permitted by law will not be affected. However, if you choose not to join this lawsuit, the statute of limitations will continue to run on any wage claims you may have under federal law against Groendyke. The legal time or deadline for you to file a claim continues to run until your consent to join is filed with the court or you file a separate lawsuit against Groendyke.
